Warrant ordered against education officer HIGH COURT ROUND-UP in Bangalore

The Karnataka High Court on Monday took exception to the failure of a Block Development Officer (BEO) to furnish records pertaining to the constitution of School Development Monitoring Committee (SDMC) in Bellary district and ordered the issue of non-bailable warrant against the officer. The court was dealing with two writ petitions relating to the constitution of SDMCs.
The earlier SDMC of the Government Higher Primary School of Obalapura village had been dissolved and a new committee constituted. A member of the earlier SDMC had filed a writ challenging its dissolution. Subsequently, a member of the new committee too had filed a writ.
The court had repeatedly asked the BEO of Hagaribommanahalli under whose jurisdiction the school came, to place records pertaining to the SDMCs. When the BEO failed to respond, the court took note of the conduct of the official and sought to know what action it could take against him.
The Government advocate submitted that he had sent fax messages thrice to the BEO seeking production of the records but to no avail.
Justice Ajit Gunjal directed the issue of a warrant against the BEO and asked the official to be present before the court on Friday. He adjourned further hearing on the petition.
A Division Bench, comprising the Chief Justice, Cyriac Joseph, and Justice Rammohan Reddy, on Monday expressed displeasure over the conduct of some officials of the Government in delaying the filing of an appeal. The Bench said it would condone the delay in filing the appeal on payment of Rs. 1,000 by the Government as costs.
The Bench directed that the costs be paid to the Bangalore Mediation Centre and that the money be collected from the salary of the official/officials involved in delaying filing of the appeal.
The Bench was dealing with an appeal relating to the payment of wages to teachers in a Sanskrit institution. It adjourned further hearing on the case. Justice N. Kumar on Monday ordered issue of notices to the Bangalore Development Authority (BDA) on a petition by K.P. Harish of Bangalore. Dr. Harish said he had purchased a site in Banashankari 1st Stage, 2nd Block and had obtained a home loan and even constructed a compound around the site for which he had obtained a registered sale deed on July 30, 2007.
He said some persons had written to the BDA about the sale of the site and alleged irregularities in the transaction. In turn, the BDA had issued a notice to him.
Mr. Kumar stayed any BDA action only in respect of site no 737 which Dr. Harish claimed to have bought and adjourned further hearing.
