NOTICE INVITING TENDER FOR “ “ WORKS

On behalf of Client, the Project Management Consultancy(PMC) invites you to submit a tender for the above mentioned works which will form part of the Construction of the Client at _____________________. The Project is construction of a ________________________________________________ _________________________________________________.
Tender documents can be collected at the below address by 2.00 Pm tomorrow(“Tomorrow’s Date”)

Please note the following points:
1. Earnest Money Deposit of Rs _____________/- (Amount in words only) in the form of Demand Draft, in favor of Client should be enclosed with the tender. Tenders not accompanied by the Earnest Money Deposit are liable to be rejected.
2. EMD shall be refunded to the unsuccessful bidders within 15 days of finalization of the package and the same shall be refunded to the successful bidder on submission of the performance bank guarantee by him as prescribed in the tender document.
3. Sealed Tenders should be addressed to Project Head-PMC with title on envelope mentioning “Tender for the Construction of ___________– “Title of works” and sent so as to reach not later than 11.00 AM of Day after Tomorrow’s Date.

Tenders shall remain open for acceptance by Client/PMC, for a period of 60 (sixty) days from ______________________.
4. The tenderer is required to return all the documents hard copy annexed hereto duly signed with seal to Client/PMC before the stipulated date. Soft copies to be issued in a CD in the sealed cover along with the tender
5. Conditional Tender - Unacceptable
a) The client/PMC will not accept additional conditions by the tenderer, as the tenderers are expected to accept the various provisions and conditions in the tender documents. Contract Terms and Conditions are not negotiable. b) The tenderer must sign and affix their seal in all pages of the tender documents, including Tender Specifications, Bills of Quantities and Tender Drawings and return the same.
6. Client/PMC reserves the right to reject, without assigning any reasons any tender not strictly complying with the above procedures and stipulations.
7. Client/PMC do not bind itself to accept the lowest or any tender and have the right to refuse any tender either in full or in part without assigning any reasons whatsoever. Client/PMC also reserve the right to recall the tender. Also, Client/PMC reserves the right to split the tender in any number of parts and also to undertake supply of certain material .
8. Mode of Filling
a) The tender form must be filled in English and all entries must be made by hand and written in ink. If any of the documents is missing, or unsigned, the tender may be considered invalid by Client/PMC in its absolute discretion.
b) All erasures and alterations made while filling the tender must be attested by the initials of the tenderer. Overwriting of figures is not permitted, failure to comply with either of these conditions will render the tender invalid and it will be the option of Client/PMC to accept or reject the tender without assigning any reason. Should there be any difference between the rates and amount, only the figure in the amount column shall be considered for computation of the Tender sum. No unsolicited advice of any change in rate or conditions from the tenderer after the opening of the tender will be entertained.
c) Each of the tender documents should be signed by the person or persons submitting the tender in token of his/their having fully acquainted himself / themselves with the contract Terms, Specifications, Drawings etc., as laid down. Tenders with any of the documents not so signed will be rejected.
9. Binding: On receipt of intimation from Client/PMC of the acceptance of his/ their tender, the successful tenderer shall be bound to implement the contract and within ten days thereof the successful tenderer shall sign an agreement in accordance with the draft agreement and the contract Terms, but the written acceptance by Client/PMC of a tender will constitute a binding contract between the PMC and the tenderer so selected.
10. The Bill of Quantities submitted by the tenderer as part of price bid shall not be binding on Client/PMC, for any increase or decrease in the quantities ,on account of original scope.
11. The BOQ attached is only indicative and quantities to be worked based on the drawings by the vendor, taking in to account all site conditions. The tenderer shall include any item that tenderer feels important to the functionality of the works, over and above the specifications. The tenderer must comply with all requirements of the Conditions of offer and consideration will only be given to tenderers with complete offer submissions and those who exhibit sound policies regarding safety, quality assurance, industrial relations, environment and sincere commitment to the works schedule.
